Public Offer Agreement
This Agreement is an official and public offer by the Seller to conclude a contract of sale and purchase of the Goods presented on the website jivemag.com.ua. According to Article 633 of the Civil Code of Ukraine, its conditions are the same for all buyers. By concluding this Agreement, the Buyer fully accepts the terms and procedures for placing an order, paying for the goods, delivery, return, and other conditions of the agreement. The Agreement is considered concluded from the moment the Buyer clicks the "Place Order" button and receives an electronic order confirmation from the Seller.
1. Definition of Terms
- Public Offer: A public proposal by the Seller addressed to an indefinite circle of persons to conclude a distance contract of sale and purchase.
- Goods / Item: The object of the agreement chosen by the Buyer on the website and placed in the shopping cart.
- Online Store: The Seller's website located at https://jivemag.com.ua.
- Buyer: A legally capable individual aged 18 or older, or a legal entity, placing an order on the Online Store.
- Seller: Individual Entrepreneur Rabover Kyryll Gennadievich.
2. Subject of the Agreement
The Seller undertakes to transfer the ownership of the Goods to the Buyer, and the Buyer undertakes to pay for and accept the Goods under the terms of this Agreement.
3. Order Placement
The Buyer independently places an order through the "Cart" on the website or via the contact methods provided. The Buyer is responsible for the accuracy of the provided information (Name, Surname, Delivery Address, Phone Number). The Seller has the right to refuse to fulfill the order if the provided details are incomplete or raise suspicions regarding their validity.
4. Price, Payment, and Delivery
- Prices: Prices for Goods are determined by the Seller and indicated on the website in Ukrainian Hryvnia (UAH).
- Domestic Delivery: Delivery within Ukraine (via Nova Poshta or Ukrposhta) and cash-on-delivery (COD) commission fees are fully covered by the Seller.
- Unclaimed Packages: If the Buyer does not pick up the package, it will be automatically returned to the Seller after a specific storage period: 7 calendar days at a Nova Poshta branch, 3 calendar days in a Nova Poshta postomat, and 5 calendar days at an Ukrposhta branch.
- International Delivery: International orders are shipped via Nova Post and require 100% prepayment for both the item and the shipping cost. Please note: Any customs duties, taxes, or import fees levied by the destination country are the sole responsibility of the Buyer.
- Acceptance: Upon receiving the item, the Buyer must inspect its condition, completeness, and appearance in the presence of the courier or postal worker before accepting it.
5. Rights and Obligations of the Parties
The Seller is obliged to: Deliver the Goods in accordance with the terms of this Agreement and protect the Buyer's personal data.
The Buyer is obliged to: Familiarize themselves with the terms, provide accurate delivery data, and pay for the Goods.
6. Returns and Warranty
The Buyer has the right to return or exchange a non-defective item within 14 days of receipt, provided the item has not been used, and its marketable condition, packaging, tags, and receipt are preserved. Return shipping costs for non-defective items are paid by the Buyer. Refunds are issued to the Buyer's bank account within 14 to 30 days after the Seller receives and inspects the returned Goods. Warranty claims are handled in accordance with the Law of Ukraine "On Consumer Protection" and our specific Warranty Policy.
7. Liability and Force Majeure
The Parties are liable for non-fulfillment of their obligations under the current legislation of Ukraine. The Seller is not liable for improper or untimely fulfillment of orders caused by inaccurate information provided by the Buyer. The Parties are exempt from liability in the event of force majeure circumstances (war, natural disasters, etc.) that prevent the fulfillment of obligations.
8. Other Conditions
This Agreement is concluded on the territory of Ukraine and is governed by Ukrainian law. All disputes are resolved through negotiations or, failing that, in court. The Seller reserves the right to unilaterally amend this Agreement by publishing the updated version on the website.
